Chapter 2: Age and Residency
Your age at the time you apply determines which licensing path you follow.
Drivers Under 18
If you are 16 or 17, you enter the provisional license system. For the first 12 months (or until you turn 18, whichever comes first), you face two main restrictions: you generally cannot drive between 11pm and 5am without a licensed adult in the car, and you cannot carry passengers under 20 unless a parent, guardian, or licensed driver 25 or older is present. These restrictions exist because crash risk for new teen drivers is highest at night and with peer passengers in the car — the data on this is consistent enough that nearly every state has adopted a similar staged system.
Drivers 18 and Over
Adults applying for the first time skip the provisional restrictions entirely and go straight to a standard license once they pass all required tests.
Residency Rules
If you move to California from another state, you are required to apply for a California license within 10 days of establishing residency. Acceptable proof of residency includes a recent utility bill, a signed lease or rental agreement, a mortgage statement, or a property tax bill — anything that ties your name to a California address with a reasonably current date.
